These Terms & Conditions ("Terms") govern your access to and use of Curio.chat ("Curio", "Company", "we", "us", "our"). By accessing or using the Service, you agree to be legally bound by these Terms.
If you do not agree, you must discontinue use immediately.
1. Legal Status of the Service
Curio.chat is a technology platform providing access to artificial intelligence systems, including language models, semantic search, document processing (RAG), and optional image generation.
Curio.chat:
- Is not a law firm.
- Is not a medical provider.
- Is not a financial advisor.
- Is not a licensed professional service.
All outputs are automatically generated by AI systems and may contain inaccuracies.
No professional-client relationship is created through use of the Service.
2. Eligibility
You must:
- Be at least 18 years old.
- Have full legal capacity under the laws of the Republic of Panama.
- Not be restricted from using digital services under applicable law.
We reserve the right to suspend accounts if age or eligibility requirements are violated.
3. Account Registration & Security
You are responsible for:
- Providing accurate information.
- Maintaining confidentiality of credentials.
- All activity under your account.
Curio is not liable for unauthorized access caused by user negligence.
You must notify us immediately of suspected breaches.
4. Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any law of Panama or applicable jurisdiction.
- Upload illegal, defamatory, infringing, or harmful content.
- Generate malware, scams, phishing, harassment, or disinformation.
- Circumvent system security.
- Reverse engineer, scrape, or overload infrastructure.
- Abuse token systems or attempt fraud.
We may suspend or permanently terminate accounts without prior notice if violations occur.
5. User Content & Ownership
You retain ownership of content you upload.
You grant Curio a limited, non-exclusive license to:
- Store
- Process
- Display
- Analyze
Your content solely for providing the Service.
You represent and warrant that you have legal rights to upload such content.
We are not responsible for content uploaded by users.
6. AI-Generated Outputs
AI outputs:
- Are probabilistic.
- May be incomplete or incorrect.
- Are provided "as-is".
You assume full responsibility for how you use outputs.
Curio disclaims liability for:
- Decisions based on AI responses.
- Damages caused by reliance on generated content.
- Regulatory non-compliance resulting from user actions.
7. Digital Tokens & Virtual Goods
Curio may offer digital tokens ("Tokens") used to access premium features such as advanced AI models or enhanced image generation.
Tokens:
- Are digital goods.
- Have no cash value.
- Are non-transferable.
- Are non-refundable except where required by law.
- Do not represent currency or stored monetary value.
- Do not create ownership interest in Curio.
Token purchases grant a limited license to use features within the platform.
Unused Tokens may expire if the account is terminated for violation of these Terms.
If accessed via mobile app, all in-app purchases must comply with applicable app store billing policies.
8. Payments & Billing
All payments:
- Must be made through authorized payment processors.
- Are final unless otherwise required by law.
- Are subject to fraud review and verification.
We reserve the right to:
- Refuse transactions.
- Suspend accounts involved in suspected abuse.
- Adjust pricing at any time (without retroactive effect).
9. Data Protection & Privacy
Your use of the Service is governed by our Privacy Policy.
We:
- Do not sell personal data.
- Use encryption and isolation mechanisms.
- Provide account deletion and data export tools.
- Comply with applicable data protection obligations.
10. Account Deletion & Termination
You may delete your account at any time through the application.
Upon deletion:
- Access is immediately revoked.
- Data is deleted according to our retention policy.
We may suspend or terminate accounts for:
- Breach of these Terms.
- Illegal conduct.
- Security threats.
- Fraudulent activity.
11. Service Availability
The Service is provided on an "as available" and "as is" basis.
We do not guarantee:
- Continuous uptime.
- Error-free operation.
- Permanent data retention.
- Compatibility with all devices or jurisdictions.
We may modify, suspend, or discontinue features without liability.
12. Limitation of Liability
To the maximum extent permitted under the laws of the Republic of Panama:
Curio shall not be liable for:
- Indirect or consequential damages.
- Loss of profits or revenue.
- Loss of data.
- Business interruption.
- AI inaccuracies.
- Third-party service interruptions.
Maximum aggregate liability shall not exceed the total amount paid by you to Curio in the preceding twelve (12) months.
If no payment was made, liability is limited to USD $100.
13. Indemnification
You agree to indemnify and hold harmless Curio, its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:
- Your misuse of the Service.
- Your violation of these Terms.
- Your uploaded content.
- Your infringement of third-party rights.
14. Third-Party Services
Curio may integrate third-party services (e.g., web search providers, image generation services).
We are not responsible for:
- Third-party availability.
- Third-party data practices.
- Third-party content accuracy.
Your use of such services may also be subject to their respective terms.
15. Intellectual Property
All platform elements including:
- Software
- Infrastructure
- System architecture
- Trademarks
- Branding
- Algorithms
Remain exclusive property of Curio.
No rights are granted except as expressly stated.
16. Force Majeure
We are not liable for failure or delay due to events beyond reasonable control, including:
- Natural disasters
- Infrastructure failures
- Government actions
- Cyberattacks
- Internet outages
17. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Panama.
Any dispute shall be resolved exclusively before the competent courts of the Republic of Panama.
You waive any objection to jurisdiction or venue.
18. Severability
If any provision is deemed invalid under Panamanian law, the remaining provisions remain enforceable.
19. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Curio.chat.
